By accessing or using LabelCheck ("Service"), operated by SED PHARMA INC ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

LabelCheck is an AI-powered tool that analyzes product labels (supplements, food, cosmetics) for potential regulatory compliance issues. The Service uses optical character recognition (OCR) and artificial intelligence to extract and review label information.

3. Informational Use Only — No Warranty

The results provided by LabelCheck are for informational purposes only and do not constitute legal, regulatory, or professional advice.

  • LabelCheck does NOT guarantee the accuracy, completeness, or reliability of any analysis.
  • Results should NOT be used as a substitute for professional regulatory review, legal counsel, or compliance certification.
  • We make NO warranty that the Service will identify all compliance issues or that the absence of findings means a label is compliant.
  • You are solely responsible for ensuring your products meet all applicable regulations.

4. User Accounts

You must provide a valid email address to create an account. You are responsible for maintaining the confidentiality of your account credentials. You may delete your account at any time, which will remove all associated data.

5. Acceptable Use

You agree not to:

  • Upload content that is illegal, harmful, or infringes on third-party rights
  • Attempt to reverse-engineer, exploit, or disrupt the Service
  • Use the Service for any purpose other than label analysis
  • Share your account credentials with others

6. Intellectual Property

You retain ownership of all labels and files you upload. We do not claim any rights to your content. The Service software, branding, and documentation are owned by SED PHARMA INC.

7. Data Handling

Uploaded labels are processed using third-party AI services (OpenAI) for OCR and analysis. By using the Service, you consent to this processing. See our Privacy Policy for details.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SED PHARMA INC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON ANY ANALYSIS RESULTS.

Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Subscription and Payments

Free accounts are subject to usage limits. Paid subscriptions may be offered with additional features and higher limits. Subscription terms, pricing, and cancellation policies will be presented at the time of purchase.

10. Termination

We may suspend or terminate your access if you violate these Terms. You may terminate your account at any time. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11. Changes to Terms

We may update these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will notify users of material changes via email.

12. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of California.
